DEFINITION OF COMPLIANCE

Compliance is a term that has its origin in the Latin word complementum and that refers to the action and effect of complying or being fulfilled. The verb fulfill, on the other hand, refers to executing something ; remedy someone and provide him with what he lacks; do something that is due; agree; or be the day on which a term or an obligation ends.

For example: “The police, in compliance with the order of the judge, arrested the main suspect for the murder of the girl”, “Compliance with the pact is essential for the project to be successful”, “There was a lack of compliance of the third point of the contract.

It is common to speak of wish fulfillment. For Sigmund Freud, it is a psychological formation in which a wish is imaginarily presented as fulfilled thanks to a production of the unconscious (such as a dream or a fantasy). In everyday language, it is said that a wish is fulfilled when what is imagined or dreamed comes true.

Suppose a boy dreams of being a footballer. At the age of four he receives a ball as a gift and since then his main goal is to become a professional player. When he turns ten years old he begins to practice football at a club, where he develops all the formative stages. And so, at 18, he signs his first professional contract and debuts with the first team. At that moment, therefore, this person will be able to say that he accomplished the fulfillment of his main wish or his dream.

On the other hand, the concept of compliance is associated with responsibility, with the correct execution of a certain obligation to third parties within the agreed period, according to previously established requirements. In the field of service companies, for example, customers usually evaluate compliance with the conditions of a contract, among which are the application of discounts and rebates, the collection of fees and rates agreed on the first day, the delivery of devices on loan and the billing date.

A company that is known for fulfilling its obligations and its promises to its customers has many possibilities to grow, thanks to the recommendations that they make to their friends and acquaintances. It is known that the best advertising is free, since it arises spontaneously from responsible work and good treatment of consumers.

However, the opposite is currently more common, mainly in relation to customer service through telephone lines and chat systems. One of the markets that has grown the most since the mid-1990s is mobile telephony, which goes hand in hand with Internet services, both ADSL and 3G and 4G; Given the immense demand from the public, the number of telephone and Internet providers is increasing, and this leads to great confusion regarding the offers of each one, which then translates into harm for the consumer.

Some companies promise their new clients that if they leave their current company to join them, they will pay them back for the penalty of contracts with a mandatory term of stay; however, their compliance is usually subject to a series of conditions that are not clearly explained from the beginning, and that often surprise customers in a negative way once the change is made.

In an ideal world, like that of children’s stories that even today many children listen to before going to sleep, the lack of compliance should have negative consequences, which would force us to change our attitude ; however, the actual organization of our societies allows and supports the lack of legitimacy of a few to the detriment of those with fewer resources.
